Boston: Wm. Underwood & Co., 1892., 1892. First edition. First edition. Quarto. 8 1/2' x 10 1/4" four-page booklet, printed on Wm. Underwood & Company's stationery and dated June 11th, 1892, in Boston, Massachusetts. This law suit has been caused by Cudahy Packing Company's use of Underwood's trade mark "Devil" that appears on canned meats and products manufactured by Underwood & Company. Underwood says "This is the third time that our Trade Mark has been sustained by the Courts, and for our own protection and that of our customers, we shall continue to prosecute every dealer or packer of food products who infringes our rights by placing a figure of a devil, or any colorable imitation thereof upon his packages." In the Circuit Court of the United States, for the Southern District of New York in equity, William J. Underwood and Henry O. Underwood versus John F. Lewis and The Cudahy Packing Company. Cudahy acknowledged they had infringed upon Underwood's Trade Mark and agreed to the judge's ruling to cease and desist and to pay Underwood the sum of $1.00. Underwood's devil logo was trademarked in 1870 and it is the oldest food trademark still in use in the United States. Originally folded and a bit of light wear to a few fold points, else a very good booklet.
