London: Cassell, (1963). First Edition. Octavo, blue boards (hardcover), gilt letters, 191 pp. Near Fine, with bookplate; in a Fine dust jacket. From dust jacket: ‘Security’ is vital; so, in a free country, is the liberty of the subject. Are the two ever incompatible? Should the second ever be sacrified to the first? While recognizing that restrictions and compulsions are inevitable in wartime, the author contends that no legislation can be justified which gives such powers to the Executive as to remove the citizen from the protection of the Courts. In support of his contention he examines the workings during the last war of Regulation 18B, under which persons could be ‘detained’ indefinitely without trial and without any specific charges being brought against them. He shows that it gave rise, not only to ‘rough justice’ but to gross and proven and, indeed, admitted cases of injustice, for which there was no legal redress. ‘It can’t happen here.’ But it did happen here and could happen again unless Parliament, the Press and the Public are alive to past experience. Having served in two World Wars, rising in the first to command of a battalion and ending the second as a brigadier, Desmond Young, only son of the late Commodore Sir Frederick Young, is ‘security-minded.’ Having edited newspapers in South Africa and India, he became familiar with restrictive practices in both countries in peacetime. Chief Press Adviser to the Government of India and, later, Director of Public Relations, India Command, he learned something of the ways of officialdom. His biography of Rommel made him widely known as a writer. Rutland of Jutland is also a biography, that of a naval officer who became famous for courage and enterprise in the R.N.A.S.in World War I -- the most noteworthy of the pilots who specialized in flying reconnaissance planes off from the turret tops of cruisers. The circumstances of his arrest and prolonged ‘detention’, without trial and without charge, in World War II -- as well as the refusal of the then Home Secretary to given any explanation in the House of Commons to so senior a member of his own service as Admiral Sir Roger Keyes -- were so strange that they make his story as disquieting as it is distressing.
