Thick 12mo, pp viii, 415, all edges gilt, with a frontispiece, an extra vignette title page, and 16 hand-coloured plates, some with slight age-toning and slight blemishes, the frontispiece with a little surface loss due toi adhesion with the facing flimsy, otherwise clean and tight internally, contemporary book label of John Ellison, Liverpool on the front endpaper, original blind-stamped cloth, gilt wreath on upper and lower covers, ornate gilt decorated spine, slightly marked and worn. [M'Intosh was descended from a line of gardeners: his grandfather, great-grandfather, and great-great-grandfather had been gardeners to the dukes of Atholl, while his father was the gardener, forester, and manager of improvements on the Abercairney estate for nearly fifty years. In 1814, aged about twenty, M'Intosh travelled to England under the patronage of the landscape gardener Lewis Kennedy (1789-1877). Kennedy introduced him to his father, the senior partner of the important nursery of Lee and Kennedy at Hammersmith, London. M'Intosh had a remarkable career during which he worked for European royalty and the aristocracy, including the King of the Belgians and the Duke of Buccleugh, on estates where finance for gardening projects was virtually unlimited. However, he always showed himself generous with his knowledge and had the ability to write practical books from which a wide range of landowners and gardeners, both professional and amateur, could benefit. The published reviews of his books showed the affection, respect, and esteem in which he was held, as did the wide support for his testimonial, which referred to the help he quietly gave to other members of his profession.]. 1852 softcover pamphlet discussing the downside of tobacco. When I got this the cover was off. Volume has had some restoration: cover is backed with matching paper and is reattached. Paper and binding are fragile but overall readable with a gentle touch. Primary defect is the corner off the front page. Interior has foxing and stains but no vandalism. I think the author comes out of the same group that published Solomon Spittle (which I also have listed). 1852 is the first year this was published but this is titled "Fourth Thousand" so this is an early printing. Has 8 plates that are included in pagination. 179 pages, complete as issued. An uncommon item generally found in poor condition. This is decent not great (which sometimes is the best you can do). Topic is health problems of tobacco. Discusses addiction, acute toxicity, chronic health problems including heart and lung disease as well as problems of second hand smoke. Feel free to inquire. Original First Edition. 16 page sewn paper pamphlet in wrappers, minor discoloration to edges of covers, old $2 price, and old library call numbers written in pencil on top of front cover, old 15 cent price, and calculation figures not related to text written in pencil on back cover, contents clean and unaffected.In this pamphlet, Judge Leavitt states his reasons (based on historical fact and the Constitution) for his ruling that denied a writ of habeas corpus for the defendant C. L. Vallandigham; leader of the "Peace Democrats," and Supreme Commander of the "Sons of Liberty."
The accused was charged with "mischievous disloyalty" in his opinions and statements; and subsequently arrested at the orders of General Burnside. Lincoln became involved when, in May of 1863, he wrote to Stanton stating that suspension of habeas corpus, as Stanton wanted, would not be necessary in this case.
